This website is operated by STORIED Entertainment, L.L.C., doing business as STORIED and Storied Skateboarding. Throughout this website, the terms “STORIED,” “we,” “us,” and “our” refer to STORIED Entertainment, L.L.C. STORIED offers this website, including the information, content, features, products, tools, and services available through it, conditioned upon your acceptance of these Terms of Service and all other policies and notices referenced herein.

By visiting our website, creating an account, submitting information, or purchasing a product or service from us, you engage in our “Service” and agree to be bound by these Terms of Service, together with any additional terms and policies referenced in these Terms or made available by hyperlink. These Terms apply to all users of the website, including browsers, customers, vendors, merchants, contributors, and others who access or use the Service.

Please read these Terms carefully before accessing or using the website. If you do not agree to these Terms, you may not access the website or use the Service. If these Terms are considered an offer, acceptance is expressly limited to these Terms.

Any new products, features, services, or tools added to the website will also be subject to these Terms. We may update these Terms by posting a revised version on this page and updating the “Last Updated” date. Changes will apply prospectively from the date they are posted unless otherwise stated or required by law. Your continued use of the website after revised Terms become effective constitutes acceptance of those changes.

Our online store is hosted by Shopify, which provides the e-commerce platform that allows us to offer and sell products and services to you.

SECTION 1 — ONLINE STORE ELIGIBILITY AND USE

By using the Service, you represent that you are at least the age of majority in your state, province, or country of residence or that you have the consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

You may not use the website, Service, or any STORIED product for an illegal, fraudulent, abusive, or unauthorized purpose. You may not violate any applicable law while using the Service, including intellectual-property, privacy, consumer-protection, or export-control laws. You must not transmit viruses, malware, destructive code, or other material intended to interfere with the operation or security of the Service. A violation of these Terms may result in suspension or termination of your access to the Service.

SECTION 2 — GENERAL CONDITIONS

We reserve the right to refuse or restrict access to the Service, cancel an order, or terminate an account when reasonably necessary to address suspected fraud, unlawful activity, misuse of the Service, threats to STORIED or its customers, violations of these Terms, product limitations, or other legitimate business or security concerns. We will exercise these rights subject to applicable law and will issue any refund required when an order is canceled.

Information you submit through the Service may be transmitted across various networks and adapted to meet the technical requirements of connecting networks and devices. Payment-card information is encrypted during transmission and is processed by Shopify or other authorized payment providers. Our collection and use of personal information are governed by our Privacy Policy.

You may not reproduce, duplicate, copy, sell, resell, commercially exploit, or obtain unauthorized access to any part of the Service without our prior written permission. Section headings are provided for convenience and do not limit or otherwise affect these Terms.

SECTION 3 — WEBSITE INFORMATION

We make reasonable efforts to ensure that information presented on the website is accurate and current, but information may occasionally be incomplete, outdated, or incorrect. General editorial, historical, educational, or cultural content is provided for informational purposes and should not be treated as professional advice or relied upon as the sole basis for a significant decision.

The website may include historical information that is not current and is provided for reference, editorial, or archival purposes. We may modify website content at any time, but we are not required to update every item of information except where required by law. Nothing in this section limits our obligation to accurately describe products, prices, material terms, or customer rights.

SECTION 4 — SERVICE AND PRICE CHANGES

Product prices, availability, features, and offerings may change without notice before an order is accepted. We may modify, suspend, or discontinue any part of the Service or any product offering, subject to existing orders, contractual commitments, and applicable law.

We are not liable for modifications, price changes, suspensions, or discontinuance of the Service except to the extent liability cannot lawfully be excluded. A price change will not retroactively change the price of an order that STORIED has already accepted unless the customer agrees or the original price resulted from an obvious error that is handled in accordance with applicable law.

SECTION 5 — PRODUCTS AND SERVICES

Certain products or services may be available exclusively through the website and may be offered in limited quantities. Purchases are subject to our Return & Refund Policy, which is incorporated into these Terms.

We make reasonable efforts to display product photographs, colors, dimensions, materials, and other characteristics accurately. However, colors may appear differently depending on the customer’s screen, lighting, or device. Products involving natural materials, hand-finishing, specialty printing, artist participation, or hand-signing may contain reasonable variations between individual units.

Hand-signed products may vary in signature placement, size, color, ink application, and style. Skateboard decks may contain reasonable variations in wood grain, veneer shade, ply color, printing, or other production characteristics. Numbered or individually editioned products are not guaranteed to include a particular edition number unless that number is expressly identified and confirmed at the time of purchase. These reasonable variations are not considered defects, but nothing in these Terms limits a customer’s rights concerning a product that is materially defective, damaged, incorrect, or materially different from its description.

We reserve the right to limit sales by person, household, account, order, geographic region, or jurisdiction. We may limit the quantity of a product available for purchase, particularly for autographed, Limited Edition, collectible, or high-demand releases. We may discontinue a product at any time, and any offer is void where prohibited.

Except as expressly stated by STORIED or required by law, we do not guarantee that a product, service, or other material will meet every customer’s subjective expectations. Nothing in these Terms excludes warranties, guarantees, remedies, or consumer rights that cannot legally be waived.

SECTION 6 — AUTOGRAPHED, LIMITED EDITION, AND PRE-ORDER PRODUCTS

Autographed, signed, numbered, Limited Edition, personalized, custom, pre-sale, and pre-order products may be subject to additional conditions disclosed on the applicable product page or in our Return & Refund Policy. Unless otherwise stated or required by law, these products are final sale and are not eligible for voluntary cancellation, return, refund, or exchange.

Production and shipping dates for pre-sale and pre-order products are good-faith estimates based on information available when the order is placed. Artist schedules, hand-signing, specialty printing, manufacturing, supply-chain conditions, and other third-party processes may cause delays. If STORIED cannot ship an order within the stated timeframe, we will provide any notice, revised shipping estimate, opportunity to consent to the delay, cancellation option, or refund required by applicable law.

All autographed products sold directly by STORIED are represented as authentic. Customers may not reproduce, alter, or misuse any certificate of authenticity, edition marking, signature, or other authentication material associated with a STORIED product.

SECTION 7 — ORDERS, BILLING, AND ACCOUNT INFORMATION

We reserve the right to accept, reject, limit, or cancel an order. Purchase limits may apply to orders placed through the same account, payment method, billing address, shipping address, household, or other information reasonably indicating coordinated purchases. We may limit or prohibit orders that appear to involve fraud, unauthorized payment activity, automated purchasing, circumvention of purchase limits, or unauthorized resale or distribution.

If we modify or cancel an order, we may attempt to notify you using the email address, telephone number, billing address, or account information supplied at checkout. If STORIED cancels an order after payment has been collected, we will issue the refund required by applicable law.

You agree to provide current, complete, and accurate account, billing, payment, and shipping information. You are responsible for reviewing your order details before submitting an order and for promptly updating your contact and account information. STORIED is not responsible for delivery problems caused by inaccurate or incomplete information supplied by the customer, except where otherwise required by law.

SECTION 8 — OPTIONAL TOOLS AND THIRD-PARTY SERVICES

We may provide access to third-party tools, applications, payment services, integrations, or features that we do not own or control. Unless expressly stated otherwise, these tools are provided on an “as available” basis without endorsement by STORIED.

Your use of a third-party tool or service may be governed by separate terms and privacy policies established by that provider. You are responsible for reviewing those terms before using the third-party service. To the fullest extent permitted by law, STORIED is not responsible for losses caused solely by a third-party tool or service outside our reasonable control.

New website features, tools, and services introduced in the future will also be subject to these Terms.

SECTION 9 — THIRD-PARTY LINKS AND CONTENT

The Service may contain links to third-party websites, content, products, or services. A link does not necessarily mean that STORIED endorses or controls the third party. We are not responsible for evaluating or guaranteeing the accuracy, legality, availability, security, or practices of unaffiliated websites.

Transactions with third parties are governed by the terms and policies of those third parties. You should review those terms before completing a transaction. Questions or complaints concerning a third party’s products or services should generally be directed to that third party. Nothing in this section limits responsibility that STORIED cannot lawfully exclude.

SECTION 10 — INTELLECTUAL PROPERTY

The website and its content—including STORIED’s name, logos, trademarks, designs, photographs, videos, films, artwork, product graphics, written stories, interviews, editorial content, layouts, audio, software, and other materials—are owned by or licensed to STORIED and are protected by intellectual-property and other applicable laws.

Except for personal, noncommercial use of the website as intended, no content may be copied, reproduced, modified, republished, distributed, displayed, sold, licensed, scraped, used to train an automated system, or otherwise exploited without prior written permission from STORIED or the applicable rights holder.

The appearance of an athlete, artist, celebrity, creator, photographer, filmmaker, contributor, or other individual on the website does not grant a user any right to use that person’s name, image, likeness, voice, signature, biography, artwork, or other protected rights.

SECTION 11 — USER CONTENT, COMMENTS, AND SUBMISSIONS

If you submit a review, photograph, video, comment, contest entry, testimonial, or other material intended for publication or promotional use, you retain any ownership rights you hold in that material. You grant STORIED a nonexclusive, worldwide, royalty-free license to host, reproduce, edit, format, publish, display, distribute, and use that material for operating, improving, and promoting STORIED and the Service, subject to applicable law and any additional written terms governing the submission.

If you voluntarily send an unsolicited idea, suggestion, proposal, concept, or plan, you acknowledge that STORIED is not required to treat it as confidential, compensate you for it, or respond to it unless STORIED has agreed otherwise in writing.

We may monitor, refuse, edit, or remove user content that we reasonably determine is unlawful, infringing, threatening, defamatory, obscene, deceptive, abusive, discriminatory, or otherwise violates these Terms.

You represent that you have the necessary rights and permissions to submit your content and that it does not infringe another party’s copyright, trademark, privacy, publicity, contractual, or other rights. You may not submit malicious code, impersonate another person, use a misleading email address, or misrepresent the source of a submission. You remain responsible for the content and accuracy of your submissions.

SECTION 12 — PERSONAL INFORMATION

Our collection, use, disclosure, and protection of personal information are governed by our Privacy Policy. By using the Service, you acknowledge that information may be processed by Shopify, payment processors, shipping carriers, analytics providers, marketing platforms, and other service providers as described in the Privacy Policy.

SECTION 13 — ERRORS, INACCURACIES, AND OMISSIONS

The website may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, discounts, offers, shipping charges, fulfillment estimates, transit times, availability, or other information.

We reserve the right to correct an error, update information, or cancel an affected order when reasonably necessary, including after an order has been submitted but before it has been fulfilled. If we cancel a paid order because of an error, we will notify the customer and issue the refund required by law. We will not retroactively increase the price of an accepted order without the customer’s agreement.

We are not obligated to update or clarify every item of website content except where required by law. A date shown as an update or refresh date does not necessarily mean that every part of the Service was modified on that date.

SECTION 14 — PROHIBITED USES

You may not use the website or Service for any unlawful, fraudulent, abusive, infringing, deceptive, obscene, or malicious purpose. You may not encourage unlawful conduct; violate applicable laws or regulations; infringe intellectual-property, privacy, publicity, or other rights; harass, threaten, defame, exploit, or discriminate against another person; submit false or misleading information; transmit malware or harmful code; collect personal information without authorization; send spam or phishing communications; impersonate another person; scrape, crawl, or access the Service through unauthorized automated means; interfere with the operation of the Service; circumvent security controls or purchase limits; or assist another person in doing any of these things.

We may suspend or terminate access to the Service when we reasonably believe a user has engaged in a prohibited use.

SECTION 15 — PRODUCT USE AND ASSUMPTION OF RISK

Skateboarding is an inherently dangerous activity that may result in falls, property damage, serious injury, or death. Customers are responsible for determining whether a product is suitable for their intended use, following applicable warnings and instructions, using appropriate protective equipment, and exercising reasonable care.

Certain STORIED products may be intended primarily for display, collection, or decorative purposes, as stated on the applicable product page or packaging. Products identified as display-only should not be used for skateboarding or another functional purpose. Nothing in this section excludes or limits liability that cannot lawfully be excluded, including liability arising from a legally actionable product defect.

SECTION 16 — DISCLAIMER OF WARRANTIES

We do not guarantee that access to the website or Service will always be uninterrupted, timely, secure, or error-free. Website functionality and digital content are provided on an “as available” basis, and the Service may occasionally be suspended for maintenance, updates, security, or circumstances outside our reasonable control.

To the fullest extent permitted by law, the website and Service are provided without implied warranties that may lawfully be excluded. However, nothing in these Terms excludes any express product warranty made by STORIED or any implied warranty, statutory guarantee, or consumer right that cannot legally be waived.

SECTION 17 — LIMITATION OF LIABILITY

To the fullest extent permitted by law, STORIED and its owners, officers, directors, employees, affiliates, agents, contractors, licensors, suppliers, and service providers will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from the use of, or inability to use, the website or Service, including lost profits, lost revenue, loss of data, or replacement costs, even if advised that such damages may be possible.

These limitations do not apply to liability that cannot lawfully be excluded or limited, including any applicable liability for fraud, willful misconduct, gross negligence, death or personal injury caused by legally actionable negligence, defective products, or nonwaivable consumer rights. Where a jurisdiction does not permit a particular exclusion or limitation, liability will be limited only to the maximum extent permitted by law.

SECTION 18 — INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless STORIED and its affiliates, owners, officers, directors, employees, agents, contractors, licensors, suppliers, and service providers from third-party claims, damages, liabilities, and reasonable legal expenses arising from your unlawful misuse of the Service, your material breach of these Terms, your infringement of another party’s rights, or content you submit to the Service. This obligation does not apply to the extent a claim results from STORIED’s own unlawful conduct, negligence, or breach of these Terms.

SECTION 19 — SEVERABILITY

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted by law or modified only to the extent necessary to make it enforceable. The remaining provisions will remain in full force and effect.

SECTION 20 — TERMINATION

These Terms remain effective while you use the website or Service. You may terminate your agreement to these Terms by discontinuing use of the Service and, if applicable, requesting closure of your account.

We may suspend or terminate access to the Service if we reasonably believe that you have violated these Terms, engaged in fraud or unlawful conduct, created a security risk, or misused the Service. Termination does not eliminate obligations or liabilities that arose before termination, including payment obligations for completed purchases. Provisions that by their nature should survive termination—including intellectual-property, limitation-of-liability, indemnification, and governing-law provisions—will remain effective.

SECTION 21 — ENTIRE AGREEMENT AND NO WAIVER

These Terms, together with the policies and additional terms incorporated by reference, constitute the entire agreement between you and STORIED concerning use of the website and Service and supersede prior or contemporaneous communications concerning that subject.

Our failure to enforce a provision of these Terms does not waive our right to enforce that provision later. Any waiver must be expressly made in writing by STORIED. These Terms will not be interpreted against either party solely because that party participated in drafting them.

SECTION 22 — GOVERNING LAW

These Terms and any separate agreement through which STORIED provides a Service will be governed by the laws of the State of California, without regard to its conflict-of-law principles, except where the mandatory laws of a customer’s jurisdiction apply and cannot legally be waived.

Nothing in these Terms prevents a consumer from exercising a nonwaivable right or remedy available under applicable local, state, federal, provincial, national, or international law.

SECTION 23 — CHANGES TO THESE TERMS

The current version of these Terms will remain available on this page. We may update these Terms from time to time by posting the revised version and changing the “Last Updated” date. Material changes will apply prospectively and will not retroactively alter an accepted order or accrued legal right unless the affected customer agrees or applicable law permits otherwise.

Your continued use of the website or Service after revised Terms become effective constitutes acceptance of those revisions. If you do not agree with the revised Terms, you should discontinue use of the Service.
